New Requirements Can Be Added for Renewal
Emerging OMMA rules can impose additional new requirements on licensees for renewal of a license that were not imposed under the initial application. The effect can be that businesses that qualified for licensing previously may suddenly no longer be qualified under new requirements. Cannabis businesses can lose their license through denial of renewal.
The Oklahoma Residency Requirement
Thousands of businesses were established and licensed by the OMMA prior to the addition of the Oklahoma residency requirement for medical marijuana businesses. It has been reported in some places that businesses licensed before the requirement would not be held to that standard for license renewal and “grandfathered” in to compliance.
OMMA rules indicate the requirement that 75 percent of a business be owned by individuals who qualify as Oklahoma residents through two years of continuous residency or five years of residency in the prior twenty-five years only applies to new applicants. Applicants first licensed prior to the passage of the legislation mandating the new residency requirements must nonetheless prove current Oklahoma residency as part of renewal. Their proof of residency, however, does not have to meet the new standard of two continuous years or five years in the past 25 years.
