Breaking through the Digital Haze
Video Transcribed: Can medical marijuana businesses in Oklahoma advertise their products and services online? I’m Ope Adegbuyi, a Tulsa medical marijuana business lawyer.
As the medical marijuana industry grows in Oklahoma, businesses are seeking new ways to reach customers and expand their reach. One question that many medical marijuana businesses have is whether they can advertise their products online.
So as a medical marijuana business, is this possible? The short answer is yes, but with limitations. Oklahoma’s medical marijuana laws allow for the advertising and marketing of medical marijuana products and services, but there are specific guidelines that must be followed.
For example, all medical marijuana advertisements must contain a disclaimer stating that the product is intended for use by individuals with a valued medical marijuana license. Additionally, all advertisements must comply with general advertising laws and regulations, including laws regarding false and misleading advertising.
Furthermore, advertisements cannot be targeted to individuals under the age of 18 or placed on websites or platforms that are primarily used by individuals under the age of 18. Medical marijuana businesses are also prohibited from using celebrity endorsements or making unsubstantiated health claims about their products.
