Understanding OMMA Renewal Application Resubmissions
Hi, this is Oklahoma Cannabis Business Attorney Jesse Kovacs with the OK Cannabis Law Office. And today we’re going to be asking, how many times can I resubmit my renewal application? Now this is a very popular question because as many people have found out, it can be difficult to get everything that OMMA requires and wants in on that renewal application. And oftentimes that means getting a rejection back and resubmitting and maybe getting a rejection back and resubmitting and so on and so forth.
OMMA’s Discretion on Resubmissions
So the question is, how long can I do that? Is there a point when OMMA can just deny my application? And the answer to the latter part is yes, there is a point in OMMA’s discretion when they can stop accepting new resubmissions. And basically it starts after the first resubmission. They don’t have to give you more opportunities to resubmit after that. What the statutes and the rules say is that unless the authority determines otherwise, an application that has been resubmitted but is still incomplete or contains errors that are not clerical or typographical in nature shall be denied.
Importance of Completing Your Renewal Application
Now that means that it’s not automatically denied if you’re still having deficiencies in your application on resubmitting again, but it means that they can just deny it instead of rejecting it as long as the errors that are still outstanding aren’t simply just clerical or typographical. So that’s why it’s extremely important to be on top of your entire renewal application, especially if you have already received a rejection. Oftentimes OMMA will go just in so far to the application at where they find the first error and then reject based on that, which means that there still might be errors down later on in the application.
